PUTRAJAYA – The Federal Court today granted the Attorney-General (AG) leave to appeal against the existence of a supplementary document in the case involving former prime minister Najib Abdul Razak.
A three-member panel, led by Chief Judge of Malaya Yang Amat Arif Dato’ Sri Hasnah Mohammed Hashim, ruled unanimously that the legal questions raised by the AG met the threshold for leave under Section 96 of the Courts of Judicature Act 1964. The apex court has fixed July 1 and 2 to hear the appeal.
Also on the panel were Federal Court judges Yang Arif Dato’ Zabariah Mohd Yusof and Yang Arif Datuk Hanipah Farikullah.
The AG had filed the leave application to challenge the Court of Appeal’s decision. Under the law, leave must be obtained before an appeal can proceed to the Federal Court.
On Jan 6, the Court of Appeal, in a 2-1 majority decision, ordered Najib’s claim of a purported additional document which allegedly allows him to serve the remainder of his six-year jail term under house arrest to be remitted to the High Court for a full hearing.
This overturned the High Court’s earlier decision, which had dismissed Najib’s bid for a judicial review over the alleged document. -MalayaDailyToday
