KUALA LUMPUR – A 31-year-old army officer was hauled before the Magistrate’s Court today to face a murder charge in connection with a fatal road accident on the Maju Expressway (MEX) last week that claimed the life of a Bangladeshi national.
The accused, Jad Faid Arhan, stood before Magistrate Illi Marisqa Khalizan as the charge was read out. However, no plea was recorded as murder cases fall under the exclusive jurisdiction of the High Court.
According to the charge sheet, Jad Faid is accused of causing the death of 22-year-old Muzahid Millad at approximately 5:30 AM on April 23. The case is being investigated under Section 302 of the Penal Code, which carries the death penalty or a prison sentence of 30 to 40 years and canning upon conviction. The court denied bail and set July 31 for the next mention of the case.
In a separate proceeding before Magistrate Tengku Syazwany Yasmyn Tuan Roslan, the accused pleaded not guilty to two additional charges of driving under the influence of alcohol and causing injury.
These charges were framed under Section 44(1A)(b) of the Road Transport Act 1987, which provides for a prison term of seven to 10 years and a significant fine. The court again denied bail and ordered the immediate suspension of the accused’s driving license pending the conclusion of the trial.
The tragic incident occurred when the vehicle driven by the accused allegedly entered the opposite lane and collided head-on with an e-hailing car. The victim, Muzahid, was traveling with his wife, Nafisa Tabassum Adiba, in a vehicle driven by Jailani Sapih.
Muzahid was pronounced dead at the scene due to the impact of the crash. His wife and the e-hailing driver sustained serious injuries and are currently receiving medical treatment at a local hospital.
Preliminary investigations revealed that the accused’s breathalyzer test results showed an alcohol level significantly exceeding the legal limit at the time of the accident. -MalayaDailyToday
