SHAH ALAM – The Shah Alam High Court has ruled that two Facebook posts describing property entrepreneur Datuk Mohamad Azlan Abdullah better known as Azlan Al Amin, as a scammer were defamatory.
High Court judge, Nor Hayati Haji Mat made the ruling today in a defamation suit brought by Azlan against Shahruldi Mahafiz Ramli over several Facebook posts published by the defendant.
The court accepted, among the defamatory meanings conveyed by the posts, allegations that Azlan was a fraudster and had been involved in fraud relating to property dealings.
The ruling establishes the defendant’s liability, with the amount of damages to be determined at a separate assessment proceeding.
Azlan has been ordered to file an application for assessment of damages within 30 days.
The court also ordered Shahruldi to pay RM30,000 in costs to Azlan, subject to allocatur fees.
Azlan was represented by Fahmi Adilah of Messrs Norman Fahmi & Associates, while Shahruldi was represented by Nur Farah Aida Mahathir and Amal Mat Isa of Messrs Nur Maidin & Co.
Speaking after the decision, Azlan said the ruling had helped restore his reputation after years of being labelled a property scammer.
“I have endured the consequences of these allegations for a long time. My reputation and image were affected.
“This victory, at the very least, helps clear my tarnished name,” he said.
Azlan had previously secured a separate judgment against the same individual in a RM590,000 property claim at the Besut Sessions Court in Terengganu. -MalayaDailyToday
